Terms of Service

1. What KinCall is (and isn't)
KinCall is a companionship-call service. We are not a medical, emergency, or social-work provider. The AI on the call is warm but it is not a doctor, not a nurse, not 119/911, and not a substitute for human family contact in a crisis.
2. Eligibility
You must be at least 18 to subscribe. When you add a parent to be called, you confirm that:
- You have authority to share their phone number with us.
- The parent consents to receiving these calls.
- You will tell us promptly if they no longer want the calls.
3. Subscription & billing
- Plans are billed monthly via Stripe in the currency you select at checkout.
- Subscriptions renew automatically until cancelled.
- Cancel any time from your dashboard; you keep access until the end of the current period. No partial refunds for unused days unless required by law.
- Refunds: full refund within 7 days of your first paid period, no questions asked. Beyond that, contact support and we’ll work with you in good faith.
- Failed payments: we’ll retry up to four times over two weeks; after that the subscription pauses and scheduled calls stop.
4. Gift purchases
Gift purchases are one-time payments that generate a redemption code. Once a code is redeemed, the gift cannot be reassigned. Unredeemed codes are refundable within 30 days of purchase.
5. Acceptable use
You may not:
- Use KinCall to call anyone who has not consented.
- Use the service to harass, deceive, or impersonate.
- Attempt to extract our system prompts, reverse-engineer the service, or scrape data at scale.
- Resell access without a written agreement.
6. Calls in emergencies
If your parent describes an emergency during a call, the AI is instructed to encourage them to dial local emergency services (e.g. 119 in Korea, 911 in the US) and we send a high-priority alert to listed family contacts as quickly as possible. We do not place emergency calls ourselves and we cannot guarantee timely delivery of alerts. KinCall is not an emergency-response service.
7. Service availability
We aim for high uptime but do not promise zero downtime. Routine maintenance, third-party outages (Twilio, Stripe, the LLM providers), and force majeure may occasionally interrupt the service.
8. Limitation of liability
To the maximum extent permitted by law, KinCall’s total liability for any claim arising out of or related to these terms or the service is limited to the amount you paid us in the twelve months preceding the event. We disclaim consequential, indirect, and punitive damages. Nothing here limits liability for fraud, gross negligence, or anything that cannot be limited by law.
9. Termination
You can stop using the service any time. We can suspend or terminate accounts that violate these terms, with notice where possible. On termination, your data is removed per our Privacy Policy’s retention schedule.
10. Governing law
These terms are governed by the laws of the Republic of Korea. Disputes go to the Seoul Central District Court unless a mandatory consumer-protection rule in your country says otherwise.
11. Changes
We may update these terms. Material changes are notified in-app or by email at least 14 days before they take effect. Continued use after the change means you accept the new version.
